서울시 미래한강본부는 사전 승인 없이 대규모 야간 마라톤 대회를 강행하려는 주최 측에 대해 사법기관 형사 고발을 포함한 강력한 법적 조치를 취하겠다고 15일 밝혔다.
문제가 된 행사는 당일 오후 5시 타 기관(동대문구청)의 출발 장소 승인만을 앞세워 한강공원 구간을 무단으로 통과하려는 야간 울트라마라톤 대회다. 현재 파악된 참가자만 1,521명에 달한다.
특히 대회가 열리는 당일 저녁 뚝섬한강공원에는 ‘드론라이트쇼’ 관람을 위해 약 3만 명의 대규모 인파가 밀집할 것으로 예상되는 상황이다.
서울시는 안전요원이나 급수대 등 필수 안전 인프라가 전혀 준비되지 않은 상태에서 대규모 마라톤 인파가 몰릴 경우, 시민의 보행 안전에 심각한 유해를 끼칠 수 있다고 판단했다.
미래한강본부에 따르면, 해당 주최 측의 이 같은 '배짱 영업'은 처음이 아니다. 이미 지난해에도 사전 승인 없이 행사를 강행한 전례가 있다. 본부는 올해 역시 대회 공지를 확인한 즉시 사전 승인 절차가 필수임을 지속적으로 안내하고 경고했으나, 주최 측은 이를 완전히 무시하고 행사를 추진 중인 것으로 드러났다.
이는 수개월 전부터 엄격한 심사와 절차를 거쳐 행사를 진행하는 타 단체들과의 형평성에도 정면으로 위배된다. 시 관계자는 "적법한 절차를 준수하는 대다수 시민과의 공정성을 지키기 위해서라도 상습적인 규정 위반에 대한 관용은 있을 수 없다"고 강조했다.
더 큰 문제는 마라톤을 사랑하는 순수한 참가자들(1,521명) 중 상당수가 이번 대회가 서울시의 승인을 받지 않은 '불법 행사'라는 점을 인지하지 못하고 신청했다는 점이다.
이에 따라 서울시는 시민들에게 해당 대회의 불법성을 지속적으로 알리는 한편, 주최 측에 대해서는 하천법 제33조(하천의 점용허가 등) 위반 혐의를 적용해 즉각 사법기관에 고발할 방침이다.
하천법 제95조 제5호에 따르면 허가 없이 하천을 점용한 자는 ‘2년 이하의 징역 또는 2천만 원 이하의 벌금’에 처해진다.
미래한강본부 관계자는 "화창한 5월의 주말, 여가를 즐기기 위해 한강을 찾은 시민들의 안전은 결코 타협할 수 없는 절대 원칙"이라며 "시민의 안전을 외면한 채 이익만을 쫓는 불법 행위에 대해 철저히 무관용 원칙으로 대응하겠다"고 밝혔다.

According to the Future Han River Headquarters, this "shameless operation" by the organizers is not a first-time offense. They have a history of forcing through the event without prior approval last year. The Headquarters continuously informed the organizers of the necessity of formal approval procedures as soon as this year's event notice was identified, but the organizers have completely ignored these warnings and are pushing forward.
This directly contradicts the principle of fairness for other organizations that undergo rigorous safety reviews and approval processes months in advance to minimize citizen inconvenience. A city official emphasized, "To maintain administrative fairness and trust for the majority of citizens who follow legal procedures, there can be no leniency for specific groups that habitually violate regulations."
A greater concern is that many of the 1,521 marathon enthusiasts applied for the event without realizing it was an unapproved, "illegal event."
Consequently, the City of Seoul plans to continuously inform the public of the event's illegality while immediately filing a criminal complaint against the organizers for violating Article 33 (Permission for Occupation and Use of Rivers, etc.) of the River Act.
Under Article 95, Item 5 of the River Act, those who occupy or use a river without permission are subject to "imprisonment for not more than two years or a fine of not more than 20 million won."
An official from the Future Han River Headquarters stated, "The safety of citizens who visit the Han River to enjoy a sunny Saturday afternoon in May is an absolute principle that cannot be compromised. We will respond with zero tolerance against illegal acts that disregard citizen safety in pursuit of profit."
